ARTICLE 1 : Object
The purpose of these "General Terms and Conditions of Use" is to provide a legal framework for the provision of the festicar.info website services and their use by the "User".
The general conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the site and the User. Access to the site by the User signifies acceptance of these general conditions of use.

ARTICLE 3 : Definitions
The purpose of this clause is to define the various essential terms of the contract:

User: this term refers to any person who uses the site or one of the services offered by the site.

User content: data transmitted by the User to the site.

Member: the User becomes a member when he/she is identified on the site.

User ID and password: all the information required to identify a User on the site. The login and password enable the User to access services reserved for members of the site. The password is confidential.

ARTICLE 5 : Intellectual Property
Trademarks, logos, signs and any other content on the site are protected by the French Intellectual Property Code, and more specifically by copyright.
The User requests prior authorization from the site for any reproduction, publication or copy of the various contents.
The User undertakes to use the contents of the site in a strictly private context. Any use of the content for commercial purposes is strictly forbidden.
The User is solely responsible for any content posted online. The User undertakes not to put any content online that could harm the interests of third parties. Any legal action taken by a third party against the site will be borne by the User.
The User's content may be removed or modified by the site at any time and for any reason. The User receives no justification or notification prior to the deletion or modification of User content.
ARTICLE 6 : Privacy policy
Under no circumstances will data collected on the festicar.info website be given or sold to third parties. No e-mail addresses will be passed on to third parties, including our partners, without the written consent of the parties concerned. The data collected via the contact and request forms are intended for the exclusive use of the festicar.info manager in order to contact you again and will not be used for marketing purposes. Only e-mails collected via the site's Newsletter form will be used to receive our newsletter and information.
Pursuant to Regulation No. 2016/679, the so-called General Data Protection Regulation (GDPR), the User has the right to access, rectify, delete and object to his/her personal data. The User exercises this right via:

ARTICLE 7 : Liability and force majeure
The sources of the information published on the site are deemed reliable. However, the site reserves the right not to guarantee the reliability of the sources. The information provided on the site is for information purposes only.
The User therefore assumes sole responsibility for use of the information and content on this site.
Any use of the service by the User resulting directly or indirectly in damage to the service must be compensated by the site.
The site cannot guarantee optimal security and confidentiality of transmitted data. However, the site undertakes to use all necessary means to guarantee data security and confidentiality to the best of its ability.
The site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
ARTICLE 8 : Hyperlinks
Numerous outgoing hypertext links are present on the site, however the web pages to which these links lead in no way engage the responsibility of festicar.info, which has no control over these links.
The User therefore refrains from engaging the responsibility of the site concerning the content and resources related to these outgoing hypertext links.
ARTICLE 9 : Contract development
The site reserves the right to modify the clauses stipulated in the present contract at any time.
ARTICLE 10 : Duration
The duration of the present contract is indefinite. The contract takes effect with regard to the User from the time of use of the service.
ARTICLE 11 : Applicable law and jurisdiction
This contract is governed by French law. In the event of failure to resolve a dispute between the parties amicably, the courts of the city of Toulouse shall have sole jurisdiction.
ARTICLE 12 : Publication by the User
The site allows members to publish comments.
In their publications, members undertake to respect the rules of Netiquette and the laws in force.
The site moderates publications and reserves the right to refuse to publish them online, without having to justify this to the member.
Members retain full ownership of their intellectual property rights. However, by publishing a publication on the site, he/she transfers to the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute his/her publication, directly or through an authorized third party, throughout the world, on any medium (digital or physical), for the duration of the intellectual property. In particular, the Member grants the right to use his or her publication on the Internet and cell phone networks.
The publishing company undertakes to include the member's name close to each use of his or her publication.
